By booking a class and placing an order you agree with my Terms & Conditions outlined below
Pilates By Charlotte is committed to providing a safe studio environment for all of us.
- The timetable is spaced, allowing 10 minute intervals between all classes to enable for the cleaning of items between classes.
- Group classes have a maximum of 3 people. You are encouraged to arrive on time and must leave immediately after your class.
- Each person must wear socks, wear minimal jewellery and wear suitable exercise attire with no zips. If wearing loose shorts, please wear bike/fitted shorts underneath. Bring your own water to drink if required. If hair is long, please tie it back.
- All payments are to be made online via Acuity Scheduler through a link sent via email or in studio unless another agreement is made prior to the class starting.
- Alcohol based hand sanitiser is provided for use in the studio.
- Clients and instructors are asked not to attend if you are feeling unwell. Please stay at home and not attend the studio in person.
See our cancellation policy below. I will endeavour to provide as much notice as possible if your class needs to be cancelled.
- The studio and all equipment is cleaned regularly.
General Health and Safety Guidelines
1. My classes are not clinical or for rehabilitation and I reserve the right to turn a client away from a class, request medical clearance before beginning a class and in some cases suggest that you seek Clinical Pilates/Rehabilitation classes with an Allied Health Professional. I care about your wellbeing, health and safety.
2. Although small, my online classes are not suitable for pre natal clients or those less than 12 weeks Post Natal. See point 4. for more information below.
3. For studio pilates classes, Pre natal clients require written medical clearance letter by a GP or Obstetrician which must be bought to your first Studio Pilates Class. You are responsible for informing us of any changes to your health during this time.
4. Post natal clients must wait until you have clearance to exercise from a GP or Physiotherapist. This is usually 6-12 weeks post partum depending on your birth.
5. Our classes are only suitable for those aged 18 Years and older for safety reasons. No children are permitted in the studio at any other time. We do have Online Pilates classes that you can participate in from the comfort of your home.
6. It is your responsibility to inform us of any changes to health or conditions by completing another information release and informed consent form.
7. Always listen to you body. Work at your own pace in classes, slowly at first and advise the instructor of anything that makes you feel uncomfortable during the session.
8. Socks must be worn during all classes and please don’t wear clothing with zips, as it damages the upholstery.
9. By signing up and participating with our online Pilates classes you must agree with the terms and conditions set out here, you promise that:
– You will complete the waiver prior to your first class commencing.
– You are in good physical condition.
– You know of no medical or other reason why you cannot or should not do active or passive exercise.
10. You must not photograph or record other users in the studio without their express consent.
Studio Pilates classes
1. For Studio Pilates classes, please ensure that you arrive to class on time and no more than 5 minutes early. Advise me of any changes to your health at the start of each class.
2. Be sure that you check with your GP or an Allied Health Professional before you start any new exercise regime and bring a letter to confirm you are cleared to exercise if you have any known health issues made worse by exercise, have recently been in hospital or if you haven’t exercised in a while.
3. You will be required to complete an Initial Assessment and a health questionnaire prior to your first class. You can complete this at the start of your Initial Assessment or a copy is sent when you book in, so you can print out a copy and bring it with you. Do not send this form electronically to ensure the privacy of your information.
4. It is your responsibility to inform us of any changes to your health prior to a class commencing and to seek medical clearance to exercise before attending a class when appropriate.
1:1 Online Pilates
Please contact me to arrange a suitable time and book and pay online via a link I will send. All participants are to read, agree with and tick the online waiver prior to each booking. I will video call you at the time of your class. So please have everything ready to start.
Before you book, please see what you require below. It is useful to advise me what equipment you have at home prior to the class starting.
To access the online classes you will need:
1. Access to video calling, with Sound and video switched on. After booking I will send you a confirmation of your class time with me.
2. Ensure your electronic device is fully charged as a class will run for 45 minutes.
3. Be in an area with good internet connection to receive a video call without interruptions. If the internet connection is insufficient, we will need to re-schedule your class.
4. Have a space with your mat and/or reformer and any equipment ready 5 minutes before your class. A side view of you on your mat with space to make a starfish shape is ideal. Your mat usually needs to be about 1.8m away from your device.
5. Its a good idea to have a pillow and few props to help hold up and position your phone, iPad or laptop so I can see you.

Pilates Initial Assessment Offer Terms and Conditions
Promotion Period
This promotional offer is available to new clients to purchase for a limited time only from 1.12.25-31.12.25. There are only three available and once sold the offer is unavailable to purchase, regardless of the date. The offer have a 50 day expiry and the Initial Assessment must to taken within 50 days. Upon expiration of the promotional period, the offer shall be deemed void and of no further effect.
Finality of Sale
All purchases made pursuant to this Offer are final. No cancellations, refunds, returns, or exchanges will be permitted, except where otherwise mandated by applicable consumer protection laws.
Non-Transferability
This Offer is issued exclusively to the original purchaser and is strictly non-transferable. It may not be assigned, conveyed, gifted, resold, or otherwise transferred to any other persons.
Availability and Substitution
There are limited spots available and the offer is subject at all times to product and/or service availability. Please check Small Group Class time availability before purchase. Pilates By Charlotte reserves the right, in its sole discretion, to substitute products or services of equal or greater value, to modify the terms of the Offer, or to withdraw the Offer entirely without prior notice.
Eligibility
Participation in this Offer may be subject to additional eligibility requirements, including, but not limited to, geographic restrictions, age, or compliance with applicable laws. You must be able to attend the Studio in Frankston, VIC to access this offer. Pilates By Charlotte reserves the right to verify eligibility and to refuse fulfillment of the Offer where such eligibility criteria are not met.
Fraud and Misuse
Any attempt to manipulate, tamper with, or otherwise abuse this Offer shall render the transaction null and void. Pilates By Charlotte reserves the right to cancel any applicable purchase, revoke Offer benefits, and take any further legal or equitable action it deems necessary.
Amendments
Pilates By Charlotte reserves the right to amend, modify, or supplement these Terms and Conditions at any time, in its sole discretion. Any such amendments shall be effective immediately upon posting to the website.
Bookings and attendance
1. All classes are by appointment only and we require all classes to be booked and paid for in advance, as spaces are limited.
2. All sales are final and there is a no refund policy, except in rare exceptions and at Managements discretion.
3. Classes are to be booked and paid for online unless agreed prior with me. You can do this via a payment link that will be sent to you. Once paid and booked in, you will receive a welcome email and the exact studio location in Frankston South. We are close to Sweetwater Creek.
4. Before commencing your first class, you will be required to complete a waiver and health questionnaire. If you have any health concerns or haven’t exercised in a while it is strongly advised to visit your GP or Allied Health Professional for medical clearance prior to attending the class.
5. We reserve the right to alter the schedule and pricing at any time.
Purchasing classes
1. Casual class purchases must be used on the day that they are booked for. If you need to cancel, see below cancellation policy and if this is adhered to, you will have 10 days to use your casual class. Weekly spaces are not reserved for casual classes. Each Sunday an email will be sent advising you of available classes that week and you are able to book in yourself online on a casual basis.
2. 5 Class blocks are to be used within 50 days of your first use of the block. This ensures your weekly space and time is reserved for you during that time. Class blocks cannot be refunded, transferred, suspended or extended unless in rare circumstances and at the discretion of Management.
3. A weekly subscription allows you to reserve 1 x 3:1 Studio Pilates class each week with an ongoing subscription. This way you are guaranteed the same class time every week. With a subscription $35 will be automatically debited every week until you stop the subscription. This way you don’t have to remember to pay for and book your class every week. Please ensure that there is enough money in your account a few days before your class or the system cancels your subscription and you will need to re-activate it.
Subscription Very Important Details
a) A subscription is ongoing until it is stopped by you or me. You can manage your own subscriptions using the link provided to you in the confirmation email. This page allows you to cancel the subscription, which will stop the subscription and not charge you again. From here you can also view all of your past payments, and update the credit card on file for the next payment.
b) You are responsible and will be required to pause/cancel the subscription yourself when you plan to go on holiday or there are public holidays. This can be done up to 8 times per Year.
c) A credit will be issued if you miss a class due to illness or unforeseen circumstances and you let us know you won’t be attending 12 hours prior to the class starting as per our cancellation policy.
d) The subscription is for your convenience. If these terms don’t suit you, we also have class blocks or casual class payments that may be better suited.
Cancellation policy
1. Time is precious and this is a small business. We have a strict 12 hour cancellation poIicy for all classes. To be fair to all clients, any late cancellations or unattended booked sessions will be charged at the full class rate or a loss of a class credit.
2. Cancellations/rescheduling can be made via your appointment confirmation email. They must be made within the time frame above.
3. If you are unwell and unable to attend a class and you’ve missed the 12 hour window please call me to discuss.
Gift Vouchers
- Gift vouchers can only redeemed once and have a 12 month expiry from the date shown on the voucher.
- They are not redeemable for cash or transferable between people.
- Once activated all classes are to be used within 45 days.
- All other Terms and Conditions are applicable to gift vouchers.
Liability
1. I cannot be held responsible for damaged, lost or stolen personal belongings whilst in the studio.
2. WARNING UNDER THE AUSTRALIAN CONSUMER LAW AND FAIR TRADING ACT 2012 Under the Australian Consumer Law (Victoria), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that Pilates By Charlotte is required to ensure that the recreational services it supplies to you- (a) are rendered with due care and skill; and (b) are reasonably fit for any purpose which you, either expressly or by implication, make known to us; and (c) might reasonably be expected to achieve any result you have made known to us. Under section 22 of the Australian Consumer Law and Fair Trading Act 2012 (Vic), Pilates By Charlotte is entitled to ask you to agree that these statutory guarantees do not apply to you. If you accept this form, you will be agreeing that your rights to sue us under the Australian Consumer Law and Fair Trading Act 2012 if you are killed or injured because the services provided were not in accordance with these guarantees are excluded, restricted or modified in the way set out in this form. NOTE: The change to your rights, as set out in these Terms, does not apply if your death or injury is due to gross negligence on Pilates By Charlotte’s part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012.
You accept that your use of the facilities provided by Pilates By Charlotte is at your own risk and you acknowledge that the use of the facilities may involve risk or injury whether caused by you or another party. By accepting these Terms and Conditions you agree that Pilates By Charlotte will not be liable for any personal injury suffered on their premises, or from using our facilities or equipment, unless due to the gross negligence of Pilates By Charlotte .
